1. Acceptance of Terms

By accessing or using the Skin Diary application ("Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Application.

2. Service Description

Skin Diary is a visual skin tracking application that utilises artificial intelligence to generate observations about skin appearance. The Application is designed for personal, informational use only. It is not a medical device and does not provide medical diagnosis, treatment, or clinical advice.

3. Eligibility

You must be at least 16 years of age to use the Application. By using the Application, you represent and warrant that you meet this age requirement.

4. User Responsibilities

• You are responsible for all content you upload to the Application, including photographs.
• You must not upload images of other individuals without their explicit consent.
• You agree to use the Application only for its intended purpose and in compliance with applicable laws.

5. AI-Generated Content

Skin observations are generated by artificial intelligence and are provided for informational purposes only. These observations may contain inaccuracies and must not be used as a substitute for professional medical evaluation. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

6. Intellectual Property

All intellectual property rights in the Application, including its design, software, and content (excluding user-uploaded photographs), belong to the operator of Skin Diary. You retain ownership of any photographs you upload.

7. Data and Privacy

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, process, and protect your personal data. By using the Application, you acknowledge and accept the data practices described in the Privacy Policy.

8. Limitation of Liability

The Application is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law:

• We are not liable for any decisions made or actions taken based on AI-generated observations.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Application.
• Our total liability shall not exceed the amount you have paid for the Application in the preceding 12 months.

9. Service Availability

We strive to maintain the availability of the Application but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Application at any time with reasonable notice.

10. Termination

We may suspend or terminate your access to the Application if you violate these Terms. You may stop using the Application at any time. Upon termination, you may request deletion of your data in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the Application. Continued use of the Application following notification of changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
